KAMPALA - A 32-year-old cleaner has been committed to the High Court to stand trial over allegations of aggravated defilement involving a 14-year-old girl. Prosecutors also allege that the suspect is living with HIV.

Senior Magistrate Edgar Karakire of the City Hall Court made the committal ruling on November 4, 2026, after state attorneys presented the necessary committal papers. The accused, identified as Richard Akugizibwe, will now await trial before the High Court, which handles cases of this gravity.

Prosecution's Case

According to the prosecution, the alleged incident took place on June 23, 2026, at Kyebando Kisalosalo, a neighborhood in Kampala. The state contends that Akugizibwe engaged in a sexual act with the teenager while fully aware of his HIV-positive status.

The identity of the 14-year-old girl has been withheld, in line with legal protections for minors in such sensitive cases. The charge is brought under sections 116(3) and (4)(b) of the Penal Code Act, Cap 128, which covers aggravated defilement, an offence that carries severe penalties upon conviction.

Legal Process

Committal to the High Court marks a significant step in the judicial process. It means that the lower court has reviewed the evidence and found sufficient grounds for the case to proceed to a higher court for trial. Akugizibwe has not yet entered a plea before the High Court, and a trial date is expected to be set in the coming weeks.

Legal experts note that cases of this nature require careful handling, given the vulnerability of the victim and the serious public health implications raised by the allegations. The prosecution is expected to rely on medical evidence and witness testimony as the case unfolds.

Community and Legal Response

The case has drawn attention to the broader issue of child protection in Uganda, where defilement remains a persistent concern. Rights advocates have repeatedly called for swift justice in such matters, emphasizing the need to safeguard minors and hold perpetrators accountable.

As the trial approaches, the High Court will be tasked with weighing the evidence and delivering a verdict that balances justice for the victim with the rights of the accused to a fair hearing. The proceedings will be closely watched by legal observers and community members alike.

The accused remains in custody pending trial. Hiascope will continue to follow the case as it develops.
